Wedding planning is a whirlwind, and while there are plenty of fun tasks—like picking out your dress and choosing the perfect flowers—making sure your marriage is legally binding is, without a doubt, one of the most important things to check off your list. Every state has its own requirements when it comes to marriage laws, and today we’re breaking down the legal process in Virginia.

To better explain the ins and outs of making your marriage legal, we asked one of our very own local friendors, Vanessa Waters, founder of Vows by Vanessa, a few questions about wedding ceremonies, and how to best guide you. . Vanessa has over 17 years of experience as an ordained interfaith minister and wedding officiant. From elopements to customized wedding ceremonies, Vanessa does it all with a personal and caring touch! Read our questions and her responses below to get insight from a pro!

  • How far from the wedding date, does the couple need to obtain their marriage license?

    • “Couples may apply for their marriage license 60 days before their wedding. I always suggest that the sweet spot is 30 days before and I always recommend making an appointment. The license does not need to be obtained in the county they’re getting married in, it just needs to be obtained (at the Circuit Court Clerk) in the Commonwealth of Virginia.”

  • What is the average cost of a marriage license?

    • “$40”

  • If a member of the couple’s family wants to perform the wedding ceremony, what qualifications would they need in order to do so?

    • “Their friend or family member would need to be clergy with ties to a church in the Commonwealth of Virginia or they can pay a $500 bond to the Clerk’s Office for a one time authorization to officiate but they must reside in Virginia. Online ordinations are also not recognized. It’s wise to hire an officiate to conduct the marriage license signing then the friend or family member can perform the ceremony without worrying about the legality of the marriage.”

  • What is the average cost of a wedding officiant?

    • “$250-$800 it truly depends on years of experience, if they offer personalized and customized ceremony scripts, and the ability to successfully narrate a couple’s love story into an engaging wedding ceremony.”

  • Who is responsible for sending the marriage license after the ceremony is over?

    • “The wedding officiant is responsible for submitting the license back to the appropriate clerk’s office within 5 days of the wedding.”

  • In the State of Virginia, do couples have to sign the marriage license?

    • “No.”

  • What is the most unique thing you’ve seen at a wedding?

    • “I love incorporating unique and fun unity ceremonies such as Unity Shots of whiskey or tequila , handfastings, the Arras Coins, the cord and veil, etc.”

  • What is your favorite part of wedding ceremonies?

    • “Stepping aside to allow them their first kiss as a married couple and listening to their guests cheer them on.”

  • What is one tip you would give couples that are about to get married?

    • “Make sure your wedding reflects you. Your day should feel authentic to your personalities, values, and love story. Whether that means writing your own vows, incorporating cultural traditions, or choosing an unconventional venue, the most memorable weddings are those that truly represent the couple. Don’t feel pressured to follow trends or meet everyone’s expectations—make decisions that feel right for you, and your wedding will be as special and unique as your love!”

Pro Tip: Don’t Forget to Bring-

  • Driver’s License or State ID showing you are at least 18 years or older

  • Your parent’s full name’s as they appear on your birth certificate (Middle & Maiden Names)

  • Money- some only accept cash, be sure to check ahead before your appointment

  • Your Fiance! Both parties must be present when purchasing your marriage license
